The President Failed to Notify Congress on the Taliban Five

Washington, D.C. – House Majority Leader Kevin McCarthy (CA-23) released the following statement on House passage of H. Res. 644, condemning the Obama Administration’s failure to notify Congress on the release of the Taliban Five:

“Due to concerns about the Administration’s detainee policy and the potential that released detainees could get back in the fight against the United States and our allies, Congress passed a law requiring the President to give notice 30 days prior to any transfer of detainees.  The law is clear and simple—yet the Obama Administration chose not to follow it.  By releasing five senior Taliban terrorists in complete secrecy, President Obama ignored a statute he signed into law and put America at greater risk given that releasing these detainees in exchange for an American soldier held hostage risks incentivizing additional hostage-taking by groups like the Taliban and Haqqani network in Afghanistan or ISIL in Syria and Iraq.  This is unacceptable and only further erodes trust between this Administration and the American people and their representatives in Congress.”
